Overview

Pekin Bayar Mizrahi provides legal assistance to clients in all aspects of the employment relationship, from drafting employment contracts for executives, expats or standard employees and advising on the establishment, management and termination of employment relationships as well as workplace and employment policies and employment-related documentation, assistance in compliance with applicable laws, regulations and by-laws, legal advice in daily employment-related matters to advising on termination of the employment relationship.

Our services include the drafting, review and negotiation of various types of employment contracts, such as executive and senior management employment agreements, fixed-term and indefinite-term employment contracts, part-time and full-time employment contracts, remote and hybrid working agreements, secondment agreements, expatriate employment contracts and consultancy or service agreements that may be recharacterized as employment relationships under Turkish labor law.

We also assist with employee handbooks, internal regulations, disciplinary procedures, codes of conduct, confidentiality agreements, non-compete and non-solicitation agreements, data protection and privacy policies, overtime and working time regulations.

We advise clients on day-to-day employment law matters, including compliance with Turkish labor legislation, social security regulations, occupational health and safety requirements, equal treatment and anti-discrimination rules, employee benefits, wages and bonuses, working hours, annual paid leave, severance and notice pay, and employer obligations arising from applicable laws, regulations and by-laws.

We also provide tailored training programs to our clients’ human resources departments and managements with a focus on minimizing employment litigation claims through risk management, compliance and best practices in employment law. However, when it comes to employment litigation claims, we have a unique specialized team, which provides legal representation in all kinds of employment actions; including re-employment and claims for employment benefits before labor courts and appellate courts, covering wrongful termination, compensation and employee receivables disputes.

We regularly advise clients on employment termination processes, including termination with or without cause, collective dismissals, redundancy procedures, performance-based terminations and mutual termination agreements, as well as the preparation of settlement agreements and release documents.

We have a proven track record in collective labor law and represent our clients in negotiations with unions, advise in the negotiation of collective labor agreements and represent clients in disputes with unions or related to collective labor agreements. Our collective labor law practice also covers union relations, collective bargaining processes, disputes arising from collective bargaining agreements, and matters related to strikes and lockouts.
