İş sözleşmesinin işverence ihbar süresi tanınmaksızın feshedildiği ve ihbar tazminatının da eksik ödendiği durumlarda, ihbar süresi içinde gerçekleşen ücret artışları işçiyi etkiler mi?

Yargıtay’ın yerleşik içtihatlarına göre, ihbar süresi sonuna kadar iş ilişkisinin devam ettiği kabul edilmekte; bu nedenle, söz konusu süre içinde yürürlüğe giren ücret artışlarından işçinin yararlanması ve feshe bağlı alacakların bu artırılmış ücret üzerinden hesaplanması gerekmektedir.

Do Salary Increases During the Notice Period Affect the Employee in Cases Where the Employment Contract Is Terminated by the Employer Without Granting the Notice Period and Where Notice Compensation Is Paid Incompletely?

According to the established jurisprudence of the Court of Appeal, the employment relationship is deemed to continue until the end of the notice period. Therefore, the employee must benefit from any salary increases that come into effect during such period, and termination-related receivables must be calculated on the basis of the increased salary.
