The prohibition of dismissal and unpaid leave periods are extended until May 2021 in relation to measures taken due to Covid-19 with the Presidential Decision (“Decision”) numbered 3592 which was published in the Official Gazette dated March 9, 2021.
Within the scope of the Decision, the periods for the following situations are extended for 2 months as of March 17, 2021:
(i) The prohibition of termination of any employment or service agreement by the employer, except in cases of incompliance with the rules of ethics and good faith as stipulated under the relevant provisions of Labor Law and any other law and similar reasons, expiration of employment or service agreements with definite terms, shutdown of the workplace for any reason and termination of its activities, termination of work in service purchases and construction works that are made in accordance with the relevant legislation.
(ii) The employer’s right to put employees on complete or partial unpaid leave. The use of such right by the employer does not entitle employees to terminate their employment agreements due to just cause.
