BTK Decisions on SMS Service Provision, Unsolicited Calls, and Restrictions on Marketing Activities Has Entered into Force Today!
The Decisions No. 2025/DK-YED/399 and 2025/DK-YED/412 (“Decisions”), published by the Information and Communication Technologies Authority (“BTK”), have officially entered into force as of today, April 1, 2026. These Decisions, concerning the regulations on SMS services and calling activities, primarily aim to prevent fraud and consumer victimization.
- Amendments Regarding the Provision of SMS Services
Under the decision numbered 2025/DK-YED/399:
- Mandatory Secure Electronic Signature: It is now mandatory for the sender or authorized person to use a secure electronic signature when logging into A2P message (SMS/MMS) submission interfaces.
- Blocking of Foreign-Sourced Links: In the event that A2P messages sent from abroad to subscribers in Türkiye contain a URL, such messages shall not be carried into or terminated within Türkiye by the operators.
- Subscription via KEP: Operators providing A2P messaging services are now required to process applications for these services via Registered Electronic Mail.
- Restrictions on Unsolicited Calls and Marketing Activities
Under the decision numbered 2025/DK-YED/412
- Requirement of Being Own Subscriber: Operators or agents/dealers acting on their behalf shall not make phone calls or send A2P messages for marketing, promotion, or information purposes to individuals who are not their own subscribers.
- Suspension and Limitation of Services: In cases where it is detected that consumers are being misled or contacted without authorization, the BTK may limit or completely suspend the call carrying and termination services of the relevant operator.
- Cancellation of Inactive Numbers: For fixed telephone services, a de-allocation procedure will be applied to numbers that remained unused throughout the preceding calendar year.
Pursuant to the Decisions, operators and service providers are expected to ensure that their technical infrastructures and operational processes are compliant as of today.
