The Bill on Amendments to Certain Laws and Decrees Having the Force of Law (“Bill”), submitted to the Turkish Grand National Assembly on 3 July 2026, aims to consolidate certain duties and powers in the field of cybersecurity under the Cybersecurity Presidency (“Presidency”) and to regulate the transition process regarding the duties and powers transferred to the Presidency. In particular, the Bill seeks to bring together under the Presidency the powers relating to cybersecurity areas such as the management of domain names and internet infrastructure, as well as the detection and analysis of communications.
Within the scope of the Bill, a new article titled “Authority of the Presidency and Administrative Sanctions” is envisaged to be added to the Electronic Communications Law. This amendment is intended to grant the Presidency the authority to determine strategies and policies regarding internet domain names and to regulate this area.
The Bill also grants the Presidency the authority to determine necessary measures and ensure their implementation in urgent situations relating to cybersecurity and electronic communications infrastructure.
The provisional article planned to be added to the Cybersecurity Law also sets out transition provisions regarding the duties and powers transferred to the Presidency. Accordingly, until the secondary legislation is issued by the Presidency, the existing regulations will continue to apply; references in the existing regulations to the Information and Communication Technologies Authority and the Telecommunications Communication Presidency will be deemed to have been made to the Presidency, and references to the relevant boards and presidents will be deemed to have been made to the President of the Cybersecurity Presidency.
