Amendment to the OIZ Implementation Regulation: Extension of Deadlines by way of the Provisional Article
With the Regulation Amending the Organized Industrial Zones Implementation (“OIZ”) Regulation (“Amendment Regulation”) published in the Official Gazette dated 17 October 2025 and numbered 33050, a Provisional Article 13 has been added to the Organized Industrial Zones Implementation Regulation (“Regulation”) which was published in the Official Gazette dated 2 February 2019 and numbered 30674.
Provisional Article 13 grants additional time to participants who have not obtained a building permit or an operating license.
According to Article 60 of the Regulation:
- A building permit must be obtained within 1 year from the date of allocation,
- A workplace opening and operating permit must be obtained within 2 years following the issuance of the building permit,
- In necessary cases, these periods may be extended by the OIZ administration, as follows:
- Extension for building permit: Up to 1 year,
- Extension for workplace opening and operating permit: Up to 1 year.
Accordingly, once the relevant maximum periods expire, participants’ obligation to obtain the relevant permits ends, and the parcel allocation is exposed to the cancellation risk.
As per Provisional Article 13:
- Participants whose periods specified in Article 60 have expired before the entry into force of this article (including any extensions by the Ministry of Industry and Technology), and who have not yet obtained a building permit or a workplace opening and operating permit;
- Provided that they apply to the Ministry of Industry and Technology until 31 December 2025, may be granted an extension not exceeding 31 March 2028.
- When calculating the extension to be granted by the Ministry, the date of entry into force of this article shall be taken as the basis.
- If no application is submitted within this period, parcel allocations shall be cancelled by the OIZ.
This Amendment Regulation entered into force on 17 October 2025 on the date of its publication, and its provisions shall be executed by the Minister of Industry and Technology.
