Personal Data Protection Law – Updated Penalties

The Personal Data Protection Law No. 6698 (“PDPL”) aims to protect privacy, ensure data security and prevent unlimited and indiscriminate collection of personal data, unauthorised access, disclosure or violation of personal rights as a result of misuse or violation. The failure to comply with the rules set forth under PDPL may result in administrative fines, which are revised each year, and also in criminal sanctions.

Tasarruf Tedbirleri ile İlgili 2024/7 Sayılı Cumhurbaşkanlığı Genelgesi (“Genelge”) 17 Mayıs 2024 tarihinde 32549 sayılı Resmî Gazete’de yayınlanmıştır ve 17 Mayıs 2024 (“Yürürlük Tarihi”) tarihinde yürürlüğe girmiştir. Genelge ile, kamu hizmetleri ve yatırım projelerinin bütçe sınırları içinde, tasarruf anlayışı ile yürütülmesi amaçlanmıştır.

Guideline for Data Privacy in Mobile Applications

The Data Protection Board (“Board”) issued its guideline with respect to data privacy in mobile applications (“Guidelines”). Under the Guidelines, the Board underlined the importance of the protection of the personal data of data subjects in mobile applications used in smart devices.

New Amendments to the Regulation on Insurance and Reinsurance Brokers

New amendments made to the Regulation on Insurance and Reinsurance Brokers are published on 18.01.2024. The amendments introduced the Insurance and Private Pension Supervisory and Audit Authority and Board into the lexicology of the regulation. Other amendments may be summarized as follows:

New Regulation on Active Cooperation For Detecting Cartels Has Been Published

The new regulation which determines the procedures and principles regarding immunity from or reduction for the fines specified in Article 16 of the Law on the Protection of Competition (“Law”) to be imposed on enterprises and enterprise managers and employees who actively cooperate with the Competition Authority for the purpose of detecting cartels which are prohibited under Article 4 of the Law is now published.

Rekabetin Korunması Hakkında Kanun’un (“Kanun”) 4. maddesinde yasaklanmış olan kartellerin ortaya çıkarılması amacıyla Rekabet Kurumuyla aktif iş birliği yapan teşebbüsler ile teşebbüs yöneticileri ve çalışanlarına, Kanun’un 16. maddesinde belirtilen para cezalarının verilmemesine veya verilecek cezalarda indirim yapılmasına ilişkin usul ve esasları düzenleyen yeni yönetmelik 16.12.2023 tarihinde yayınlanarak yürürlüğe girdi.
