A significant regulatory amendment concerning digital precious metals and crypto-assets backed by such assets has been introduced through the Communiqué on the Amendment to the Communiqué on Precious Metal Standards and Refineries, published in the Official Gazette dated 29 July 2026 and numbered 33324.
Pursuant to the Communiqué, the conversion of precious metals into digital precious metals in the form of intangible assets by central clearing institutions operating under the Capital Markets Law No. 6362, as well as the trading of such assets on Borsa İstanbul A.Ş. (“Stock Market”), has become subject to obtaining the favourable opinion of the Ministry of Treasury and Finance (the “Ministry”).
Accordingly, the issuance of crypto-assets backed by gold or other precious metals, commonly referred to as “real world assets”, and their admission to trading on Stock Market will be subject to the favourable opinion of the Ministry.
The Communiqué entered into force on the date of its publication. Accordingly, as of 29 July 2026, digital precious metals that have already been created will also require the favourable opinion of the Ministry in order to be admitted to trading on the Stock Market.
